Lung Cancer

Lung cancer is the leading cause of cancer death for both men and women in the United States. In 2001, it has been estimated that nearly 170,000 new cases of lung cancer were diagnosed and approximately 160,000 deaths were attributed to this disease. Despite the large number of diagnoses of lung cancer and resultant deaths, lung cancer can often be detected in its earlier stages and lives can either be significantly prolonged or saved. Lung cancer can be cured.

Unfortunately, many mistakes can be made by physicians in failing to recognize and diagnose the presence of lung cancer. This can occur in many ways. Often, patients have symptoms which are consistent with lung cancer yet a physician will fail to properly work up these symptoms in order to determine their cause. X-rays, CT scans, MRIs, cytology and tissue examination can often lead to this diagnosis. Lung cancer should always be suspected in individuals who have abnormal chest radiographs or who have symptoms caused by local or systemic effects of the cancer. Failure of a physician to suspect cancer when a patient's symptoms are consistent with lung cancer can be a deviation from accepted standards of care and can be a basis for a lawsuit.

In addition, radiologists can also be responsible for failure to diagnose lung cancer. Frequently, lung cancer is overlooked or underinterpreted in radiographic procedures. Often, when a patient is admitted to the hospital for a surgical procedure and has a routine pre-operative chest film, lung cancers are either overlooked or if seen not brought to the attention of either the patient of his physician so that proper follow up can occur.

The law firm of Rosen Louik & Perry has been involved in numerous lawsuits against physicians, surgeons and radiologists who have failed to properly diagnose and treat lung cancers.
